NEW: Effective July 23, 2026 — AI-Generated People Must Be Tagged

Any product image, A+ asset, or video containing photorealistic AI-generated people MUST have "contains-synthetic-performer" in the file's XMP dc:subject metadata field. Not a checkbox. Not a watermark. File-level metadata. Un-tagged assets will be blocked at upload.

Legal basis: NY SB 8420-A (Jun 9) + EU AI Act (Aug 2) + FTC AI enforcement (up to $53,088/violation)

Product fills ≥85% of frame, no extra props
Resolution ≥500px longest side (1600px+ recommended)
Format: JPG, PNG, GIF, or WEBP
No watermarks, logos, promo text, or borders
Image accurately represents the product (color/size/material)

🤖 AI-Specific Requirements (2026 New Rules)

AI photorealistic people present → "contains-synthetic-performer" in XMP metadata
Tag in dc:subject field (Windows: Tags tab / Mac: Keywords), NOT the Subject field
A+ Content, Brand Story, Store images, and videos also tagged if applicable
AI used only for retouching/background removal/color (no AI people) → tagging not required
Legacy images (pre-July 23) reviewed retrospectively; re-upload tagged versions if needed

⚠️ AI Image Risk Hotspots

No accidentally-generated copyrighted patterns, logos, or text in AI backgrounds
AI image accurately reflects real product (color, texture, scale, function) — not misleading
AI model scale relative to product is realistic (wearing/holding/using proportions)
No AI-hallucinated fake features, buttons, or screen content
All images for same product are style-consistent — no jarring AI-generated discrepancies

Quick Reference: How to Tag Your Images

Windows

  1. Right-click → Properties → Details
  2. In "Tags" field: contains-synthetic-performer
  3. ⚠️ NOT the "Subject" field
  4. Save → Upload

macOS

  1. Preview → Tools → Show Inspector
  2. Keywords tab → Add: contains-synthetic-performer
  3. Save → Upload

Command Line

  1. exiftool -XMP-dc:Subject+="contains-synthetic-performer" image.jpg
  2. Verify: exiftool -XMP-dc:Subject image.jpg
